Pollution complaints
Smoke, gases, dust or smells from your premise may affect the use or enjoyment of other premises. We will investigate all complaints about such nuisances - known as statutory nuisances.
Some examples of such complaints include:
smoke from burning trade refuse
smoking chimneys
dust from building and demolition activity
cooking smells from restaurants
The law does not allow us to deal with complaints of smells from domestic properties.
Abatement notice
If a complaint is justified, we will issue an abatement notice to the person responsible. This means the owner or occupier of the premise must reduce the emissions to an acceptable level.
Failure to comply with an abatement notice is an offence and may lead to legal action.
Enforcement policy
To find out more about how the Council ensures compliance with legislation, read the Environmental Health and Trading Standards Divison's enforcement and prosecution policy.
