Comment on new licence applications

 
The act is very clear about the conditions for a licence - this includes noise patrols, keeping doors and windows closed, good lighting, litter clearance etc.

However, as bars and restaurants can stay open all hours under the new act, we understand you may still have concerns about noise and safety late at night.  

Take a look at the licensing applications we receive for your area. If you want to object to any licence application, scroll down for details on how to proceed.

You can view all the applications for new licences or variations online.

The application will tell you whether a local business (applicant) wants to change the terms of their licence, to close later for example.

How to object

If you want to object to an application, you must be:

You have 28 days after the application is published (this is the date labelled 'last date for representations' on the applications pdf) to get in touch.

You letter must include:

  • your name and address
  • your grounds for complaint (which must relate directly to one or more of
    the four licensing objectives)
  • your signature
  • If you want to nominate someone to represent you at the hearing, such as your local councillor, include this information too.

We will then pass a copy of your letter to the applicant.  If you do not want your name and address to be passed on, you must include a request for your details to be removed in your letter of objection.

We will not accept objections if they are anonymous, unsigned, late or not based on one of the objectives.

We cannot accept representations made by telephone or if they are only made by electronic mail or fax. 

We can accept an email or fax as a "holding" representation so long as it is received within the 28 day time limit but cannot formally accept it unless we receive a written and signed representation from you immediately following the email or fax.

What happens next?

Committee services will contact you with a time and date for your hearing.

This will be no later than 20 days after the deadline for sending in objections - 'last date for representations'.

Can I submit a petition?

You can submit a petition, but for it to be legally acceptable it must:

  • Contain a header outlining the premises name and address, the fact that it is a representation, and the reasons for representation at the top of every page
  • Give the name and address of each signatory
  • Only contain names and addresses of persons who live “in the vicinity” of the subject premises
  • Nominate a spokesperson to receive details about the hearings etc. from the licensing authority and who may be willing to speak on behalf of the petitioners at the
