What happens next?
Once we receive your complete application ...
1. We check for objections
We carry out a letter drop to all residents living within 100 metres of your premises. They are entitled to object to the Certificate being granted, on the grounds of any of the four licensing objectives.
The
responsible authorities
may also make representations if they feel your application does not address the licensing objectives adequately.
Any of these groups can make representations within 28 days of us receiving a complete application from you.
2. What happens if someone objects?
We will initially try to mediate between parties.
If mediation fails, the
Council’s Licensing Sub Committee
will hold a hearing to determine your application. This committee is comprised of elected Members of the Council.
You will be invited to attend this hearing to give evidence, answer questions, and call any witnesses.
The committee will listen to evidence from both sides before deciding whether to grant the application.
The committee may grant the Certificate as requested, grant with conditions (provided these are relevant to the licensing objectives), or refuse your application.
3. Appeals
If you are unhappy with the decision of the Licensing Sub Committee, you can appeal to the Magistrates Court. You need to do this within 21 days of being notified of the Council’s decision.
